” Anyone who’s heard Rafi’s Kya Hua.Tera vada sung in a voice of tremulous longing tinged with despair knows Rafi’s uniqueness lay in conveying an aching sadness convincingly Artists like him or Adele who’s rendition of Someone Like You elicits tears every time have a gift to be able to sound heartbreakingly melancholic It’s not a joke it’s a talent One can only wonder why Rafi’s kids would bother about one random line in a panned film considering their father’s legion of followers who seek out that very weepiness in his tone However it’s not news that Indians are extremely touchy quick to take umbrage at the slightest criticism when none was meant It’s why words like izzat and sammaan are thrown about so liberally in all Hindi movie dialogues and generations had to endure perpetually outraged heroes act out story lines of vengeance and family dishonour In a nation a sense of humour develops with success An ability to laugh at oneself is more likely among citizens who are flourishing or those who’s stature makes them immune to public opinion Donald Trump couldn’t care less about being lampooned and parodied Not always though Some years ago actor Manoj Kumar sought legal action against Shah Rukh Khan over a scene in Om Shanti Om In the movie a look-alike duplicate of Kumar was shown being thrashed by policemen who had the temerity to not recognise him The self important don’t find anything about themselves funny Humour is always tricky but when it’s done right flinging insults and poking fun make for the best jokes and is the hottest form of comedy right now A subtle straight faced yet provocative one liner on everything from religion sex and politics is a method sharpened to perfection in sitcoms such as Seinfeld and Two and a Half Men Meanwhile in India it may soon be illegal to crack “Sardar jokes” in colleges In all seriousness former Supreme Court Judge HS Bedi who headed the committee that suggested those cracking “sardar jokes” be rusticated for ragging doesn’t find this recommendation hysterically funny It’s entirely lost on him that there is something fundamentally hilarious about enforcing punishments on people doubling up over Santa Banta jokes While acknowledging that the incidents of ragging because of puerile humour “are not very alarming” Bedi insists they shouldn’t be encouraged (Though one could argue that they should be banned for being so spectacularly banal) The way to develop a sense for the absurd in such a dour lot of people is to raise the bar for funny humiliation so much that Indians have no choice but to shed their righteousness and laugh Like handling success or brickbats — so much is understood in the way you take a witty punch [email protected] For all the latest Lifestyle News download Indian Express App More Top NewsSrinagar: Indian police said Sunday a Pakistan-based Islamist militant group blamed for the 2008 Mumbai attacks was responsible for last month’s killing of eight Hindu pilgrims in Kashmir Police said an investigation had concluded that Lashkar-e-Taiba (LeT) and Kashmiri accomplices were behind the 10 July attack that saw militants open fire on a bus carrying Hindus on the annual Amarnath pilgrimage Representational image AFP "Lashkar was involved and the accused have been identified" Inspector General of Police Muneer Ahmed Khan told reporters in Anantnag district in Indian-administered Kashmir "Once the investigation was started it was revealed that. a Pakistani militant of Lashkar along with two other militants and one local Kashmiri Lashkar militant carried out the attack" Three others who provided logistical support to the militants including hiding places and vehicles had been arrestedThe July shooting was the worst such attack in the divided Himalayan region since 2000 when gunmen fired on a group of Hindu pilgrims and killed 32 people including two police officers Khan said the militants had carefully plotted to attack any police or tourist vehicle that crossed their path on the evening of the assault "They had kept separate code words for tourist and CRPF (Central Reserve Police Force) vehicles. Kumar on Monday said he had so far heard nothing new about the package but would wait for details before commenting on it "First of all it’s a clear-cut violation of cooperative federalism that the state government has been kept in the dark while BJP leaders are making statements about PM’s special package for the state But whatever I have heard so far there seems nothing new in the proposed special package" Kumar told reporters here Nitish Kumar PTI As per media reports BJP leaders including Sushil Kumar Modi have been asserting that the PM might announce a special package worth Rs 56000 crore at Saharsa rally tomorrow "But still I’ll wait for the details of the PM’s special package before making a comment on it" he said Kumar said he would observe protocol and go to Patna Airport to receive the PM tomorrow He however said he would not be present at Ara where the prime minister would lay the foundation of 10 roads of national highways including a four-lane road from Buxar to Patna and a six-lane bridge at Koelwar in Ara "Road Construction Department Minister Rajiv Ranjan Singh Lallan will go to Ara for tomorrow programme" he said But Kumar sounded unimpressed saying "I am waiting to see whether the special package will have new projects or merely repackaging of the old ones" To drive home his point he said the four-lane highways from Buxar to Patna for which the PM would lay foundation stone tomorrow was approved by the previous UPA government Accusing the prime minister of not fulfiling any promises he had made on the eve of the general elections last year Kumar said "One Rank One Pension return of black money and distribution of Rs 15-20 lakh out of it to citizens are some of those" Besides enhanced MSP to farmers job to youths and special status special package and special attention to Bihar also remained unfulfilled although 25 per cent of the five year tenure of the present PM was spent he alleged Modi during his election campaign had made a strong pitch for OROP at his Rewari rally which fetched him support of ex-armymen in the poll "But when the time for delivering the promise came he is saying the government has in-principle agreed for it but working out details.what is new about his approach on OROP than it was during UPA" he asked Continuing with his tirade against the PM Kumar said "Nobody is questioning his potential to make speeches But where is the delivery of any of the promises made during poll so far" Referring to violation of ceasefire on borders by Pakistan and killing of civilians Kumar asked "What happened to the tall talks of eyeball to eyeball reaction to Pakistan if it ventures on any such incidents" Kumar tore the argument provided by Minister of State for Planning Rao Indrajit Singh in Parliament during monsoon session that there was no provision of giving a special status in the 14th Finance Commission recommendations "There can be numerous excuses if you do not want to give something" he said Signalling that special category status would be one of the important issues of the secular alliance in the Bihar poll he said "It’s the demand of every citizen of Bihar" Kumar said without any help from outside Bihar was maintaining a growth rate of about 10 percent and if special status was granted it could make a big jump PTI By: Express News Service | New Delhi | Published: June 19 2017 5:24 been a gradual arrogation of powers by judiciaries across the free world The Indian judiciary is carrying out some functions that are traditionally considered to be the domain of the legislature and executive Related News By:Ajit Prakash Shah The media and the judiciary have an uneasy and delicate relationship For a properly functioning democracy it is important to get the balance right The need for the court to maintain its authority and the freedom of the press must always be reconciled to maintain this balance However this fundamental equation often comes into conflict when the judiciary perceives media reporting as interference in the administration of justice and the media invokes the fundamental right to report or comment on cases Two areas with constant conflict are reporting on sub judice matters a phenomenon also known as a media trial and the frequent invocation of the powers of contempt by courts to punish the scandalising of judges For any judicial system there are serious dangers when parallel trials are conducted by the media It is hard to believe that judges are never influenced even subconsciously by what they read or see Justice Felix Frankfurter had said that all judges however stalwart are eventually humans and the delicate task of dispensing justice should not be made more difficult by irresponsible print There are several recent examples where media reporting has impacted judicial conduct One instance was when a school expelled a Muslim teenager because he was sporting a beard The Supreme Court while dismissing the student’s petition remarked that the “Talibanisation” of the country could not be permitted There was widespread criticism of the court It recalled its order and the matter was placed before another bench In several important cases the media has played a vital role in highlighting the failure of justice — for instance in the Jessica Lall Priyadarshini Mattoo Nitish Katara and the BMW hit-and-run cases But there are also examples of media sensationalism crossing the boundaries of fairness and decency Take the Aarushi Talwar murder case There were sustained vicious leaks about her killing Her alleged sexual conduct became a topic of discussion on several news channels There was virtually a parallel trial in the media The judiciary has to struggle to maintain the dignity of justice and its dispensation At times the line between generating public opinion and prejudicing an ongoing legal proceeding becomes blurred There has been a gradual arrogation of powers by judiciaries across the free world The Indian judiciary is carrying out some functions that are traditionally considered to be the domain of the legislature and executive When judges have such vast powers it is difficult to expect people to be silent about the exercise of such powers Just as the decisions of other branches of government attract criticism important and controversial decisions of the courts will too The SC has held in relation to powers of contempt that the judiciary is not only the guardian of the rule of law and the third pillar but the central pillar of democracy If the judiciary is to perform effectively the dignity and authority of the courts have to be respected and protected at all costs The need to respect the “authority and dignity of the court” is an idea borrowed from the British and derived from an era when the king used to decide cases himself In England the judges gradually took over the benches presided by the king The majesty of the court has no basis in a democratic system and contempt law should only be used to enable the court to function not prevent criticism Courts in the US have rejected the use of judicial contempt powers Even in the UK a far more liberal approach is applied In contrast Indian courts have adopted a different approach Consider Narmada Bachao Andolan vs Union of India While criticising the SC judgment Arundhati Roy wrote: “Most tribal people — or let’s say most small farmers — have as much use for money as a Supreme Court judge has for a bag of fertiliser” In the contempt proceedings initiated against her the court found that Roy had brought disrepute to it But it did not pursue the matter However Roy led a demonstration outside the SC’s gate and as a result contempt proceedings were initiated against her by five advocates The SC found parts of her affidavit objectionable in which she said: “It indicates a disquieting inclination on the part of the court to silence criticism and muzzle dissent to harass and intimidate those who disagree with it By entertaining a petition based on an FIR that even a local police station does not see fit to act upon the Supreme Court is doing its own reputation and credibility considerable harm” The court found that she had committed criminal contempt and she was punished with imprisonment for a day and a fine This invited criticism against the SC Till recently neither truth nor good faith were defences against the law of contempt When Madhav Gadkari editor of Loksatta wrote about a judge that he was hard of hearing and that when he wanted an advocate to stop arguing he would simply take off his hearing aid and tell the advocate he could go on arguing Gadkari was issued a notice for contempt The courts said that the truth could not be invoked as a defence This erroneous position was rectified by a 2006 amendment to the Contempt of Courts Act which makes truth a valid defence The law of contempt as described by Justice Krishna Iyer is a vague and wandering jurisdiction with uncertain boundaries and a suspect power to punish that lies in the hands of the prosecutor itself Such a law regardless of public good may unwittingly trample upon civil liberties Therefore the powers of contempt must be exercised with deliberation and operated with utmost caution by the higher judiciaries The courts must vigilantly protect free speech even in the face of severe criticism and dispense justice which is a sacred duty demanding the highest levels of tolerance and detachment The writer a former chief justice of the Delhi High Court is chairman of the Law Commission of
